Introduction

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User”) and Machota Technologies Ltd (“Company,” “we,” “our,” or “us”). These Terms govern your access to and use of the website www.eventsquare.co.tz (“Platform”) and all related services, including event ticketing, vendor marketplace, payment processing, and attendance management. By using this Platform, you agree to comply with these Terms. If you do not agree, you must cease using the Platform immediately.

2. Scope of Services

EventSquare provides a digital ecosystem for event management and related services, including: Event ticketing and digital invitations; Vendor marketplace for service providers; Automated payment processing and confirmations; Attendance tracking and QR code management. The Platform acts solely as a facilitator between event organizers, vendors, and customers. Machota Technologies Ltd does not own or operate any event, venue, or service provided by third-party vendors listed on the Platform.

3. User Responsibilities

Users must provide accurate, up-to-date, and verifiable information when creating accounts or making bookings. Users are responsible for maintaining the confidentiality of their login credentials. Any unauthorized or suspicious activity must be reported immediately to the Company. Users must use the Platform only for lawful purposes and in accordance with these Terms. All communication with the Company, vendors, or support teams must be conducted through official and verifiable channels (see Section 14).

4. Event Organizer Terms

Organizers must ensure all event details provided are accurate and not misleading. Organizers are fully responsible for event cancellations, changes, or refunds. The Company reserves the right to suspend or remove events that violate Tanzanian laws or these Terms. Organizers must adhere to ticketing and guest capacity limits defined during event creation.

5. Vendor Marketplace Terms

Vendors must provide accurate business information and complete verification as required. Vendors must deliver services exactly as advertised and within agreed timelines. Late, false, or low-quality deliveries may result in blacklisting, penalties, or legal action. Vendors must maintain professionalism, confidentiality, and ethical conduct in all transactions.

6. Payments and Refunds

All payments are processed securely through approved payment partners. Transaction and processing fees are non-refundable. Refunds, when applicable, are handled according to the policies of the respective event organizer or vendor. Any payment disputes must be submitted via official email only (info@eventsquare.co.tz). EventSquare does not store or retain users’ card or mobile payment details.

7. Prohibited Activities

Users agree not to engage in: Uploading unlawful, misleading, or fraudulent content; Attempting to bypass payment, verification, or security systems; Engaging in abusive, harmful, or illegal activity; Impersonating other individuals, vendors, or the Company; Distributing spam, malware, or offensive content. Violation of any of these may result in permanent suspension, legal action, and reporting to law enforcement authorities.

8. Liability and Disclaimers

EventSquare operates as a technology service provider, not an organizer, vendor, or financial institution. The Company is not liable for event cancellations, vendor issues, or third-party misconduct. We make no guarantees regarding Platform uptime or uninterrupted access. Our total liability, under any circumstance, shall not exceed the total service fees paid by the User in the preceding three (3) months.

9. Privacy and Data Protection

Your use of this Platform is governed by our Privacy Policy, which complies with the Tanzanian Data Protection Act and related regulations. We ensure your personal data is collected and processed lawfully, securely, and only for legitimate purposes related to Platform functionality.

10. Intellectual Property

All trademarks, graphics, software, content, and other materials displayed on the Platform are the exclusive property of Machota Technologies Ltd. Users are not permitted to copy, reproduce, distribute, or modify any content without written authorization.

11. Termination

The Company reserves the right to suspend or terminate any account or service access if: A User or Vendor breaches these Terms; Fraudulent or unlawful activity is detected; Such action is required by law or regulatory authorities. Upon termination, all pending transactions may be reviewed or withheld pending investigation.

12. Governing Law and Jurisdiction

These Terms shall be governed and interpreted in accordance with the laws of the United Republic of Tanzania. Any disputes arising shall be exclusively handled by the competent courts of Dar es Salaam, Tanzania.

13. Changes to Terms

Machota Technologies Ltd reserves the right to amend, update, or revise these Terms at any time. All changes will take effect upon posting on the official website. Continued use of the Platform signifies acceptance of the updated Terms.

The Company will not recognize or respond to complaints, instructions, or claims made through unauthorized platforms, personal contacts, or informal messaging channels (including WhatsApp, Telegram, or social media).
